Federal Court awards Ski-Doo maker BRP $3M in damages after patent violation

News

Ski-Doo maker BRP is to receive $2.83 million from Arctic Cat Inc. due to a patent infringement.

Justice Yvan Roy ruled that Arctic Cat must pay BRP $135 per unit for the 21,000 snowmobiles sold in Canada between 2008 and 2014 that infringed on the patent. Arctic Cat is also now prevented from selling snowmobiles that violate the patent.

The patent is that of the type of frame on snowmobiles that seats the rider closer to the front of the sled, used on the Ski-Doo REV line.

BRP vice-president Martin Langelier called the ruling an "excellent win," while a spokesperson from Arctic Cat said the company plans to appeal the decision and injunction.
